1. What information does BYBS collect? How does BYBS use the information collected?

In general, there are two types of information involved when you’re using the Website – information you provide us by keying it in (personally identifiable information) and information we collect by monitoring and tracking (non-personally identifiable information that is collected automatically).

You are not required to provide any personal information in order to have general access to the Website. However, we collect information that you provide directly to us when it is keyed in by you to access certain features of our Website, such as when you access or download content, create an account, participate in any interactive features, subscribe to a newsletter or email list, participate in an event, survey, contest or promotion, make a purchase, communicate with us via third-party social media sites, request customer support or otherwise communicate with us. However, we don’t market or sell any of your personally identifiable information to any third party.

Non-personally Identifiable Information That We Collect Automatically

When you visit our Website, our servers automatically collect and recognize certain non-personally identifiable information such as (1)  your domain, Internet Protocol (“IP”) address, web browser, operating system, access times, pages viewed, web browser, links clicked and the page you visited before navigating to the Website or Web page; (2) information about the mobile device you use to access our Website, including the hardware model, operating system and version, unique device identifiers, mobile network information and information about your use of our mobile applications; (3) information collected by Cookies and other tracking technologies, as discussed in greater detail below.

The third-party marketing software we use is Wix, which may also recognize via the use of “cookies” that you have been at our Website before, and may track your surfing behavior as you surf around our Website. When we do get that type information, in general we may use it to try and tailor information to better fit what we think you may be interested in, to help us improve the experience of all of our Website visitors, and to help us look for ways to continually upgrade and improve the performance of our Website, in addition to our Website content, our products, and our services. We also use this information more generally to (1) monitor and analyze use of our Website and our Service, (2) facilitate technical administration of our Website, (3)  increase the functionality and user-friendliness of our Website and our Service, and (4) better tailor Our Website, products and services to our visitors' needs.

Just as with the personally identifiable information you key in, we don’t market or sell any of this information that we collect to any third party.

 

2. With whom does BYBS share the information it collects?

We may use or disclose your personally identifiable information (such as your name, e-mail address, telephone number) in the following circumstances: (a) with your consent; (b) to governmental taxing authorities as necessary to ensure credit is made for tax withholding deposits; (c) to provide you with the content, services or products available on our Website; (d) to communicate with you about our Website, products and services;  (e) for technical and/or security issues relating to the proposed operation of the Website; (f)  to enable our third-party agents, vendors, and service providers to operate and analyze our Website, our products and our services; (g) in connection with, or during negotiations of, any merger, sale of our assets, or the financing or acquisition of all or a portion of our business by another company; and (h) to protect our rights or the safety of the public; (i) if we have a good faith belief that disclosing such information is required to comply with legal process; (j) when you participate in the interactive areas of Website, certain information you provide may be displayed to other users, such as your name, photo, comments and other information you choose to provide. From time to time we may contact you to share information about BYBS, or about other products and services we believe may be of interest. 4. How can information be corrected or updated?

You may review, correct, update, or delete your personally identifiable information through your account or by contacting our Support Team during regular business hours. If you completely delete all personally identifiable information, your account will become deactivated and you will no longer have access to our Service. If you would like us to delete your record in our system, please email info@bybyandthrive.com with your request. We will use commercially reasonable efforts to honor your request but may retain an archived copy of your records as required by law or for other legitimate business purposes.

5. Does BYBS use “cookies”?

Yes, BYBS uses browser “cookies.” Cookies are files that are written to the user’s device and are read by the server so that the server knows you have visited before. Our Website is intended for use by adults; it is not intended to be used by those under age 18. 6. What kind of security does BYBS use?

We recognize the importance our customers place on security. We exercise great care to secure personally identifiable we collect from our Website. Our security measures include the use of physical security, encrypted communications, continuous monitoring, backups and disaster recovery, and general system security. Additionally, you can access the privacy and security measures of our third-party Website host, WIX, and our third-party data processor, by clicking on their respective hotlinks in this paragraph.

In addition, we do not store any of your credit card data on our servers. A PCI compliant third-party vendor that specializes in the business of cashless payment processing manages our credit card data.

Our Website may contain links to other Websites that are created and maintained by others. Your continued use of our Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy. BYBS’ data security measures, policies, and practices ensure that the data processed on behalf of our customers is well-protected and in line with the requirements of the GDPR.  A big part of the GDPR covers an individual’s data rights, which we support, including but not limited to:

• Data destruction

• Data protection by design and by default

We’re also continuing to improve our network monitoring and update our breach procedures per the GDPR guidelines. We’re documenting how all of our data is collected, where it is stored, and how it is used.
